PreambletotheModifiedCESMM–SectionIVPageivofxCLAUSE2.GENERALPRINCIPLES2.1ThetitleofthisdocumentistheModifiedCivilEngineeringStandardMethodofMeasurement.ItisintendedtobeusedinconjunctionwiththeConditionsofContractandinconnectionwithworksofcivilengineeringconstruction.2.2ThisdocumentsetsforththeprocedureaccordingtowhichtheBillofQuantitiesaretobepreparedandpricedandthequantitiesofworkexpressedandmeasured.2.3TheobjectsoftheBillsofQuantitiesare(a)toprovidesuchinformationastoenabletenderstobepreparedefficientlyandaccurately.(b)whenaContracthasbeenenteredinto,toprovideforuseofthepricedBillofQuantitiesinthevaluationofworkexecuted.2.4WorkhasbeenitemisedintheBillofQuantitiesindifferentclasses("WorkClassification")howeverinpricingtheBillsofQuantitiesTenderersshallhavedueregardforalloftheirexpectedcostsinfulfillingtheirobligationsundertheContract,andmakedueallowanceforthesecostswithintheavailableBillsofQuantitiesitems.CLAUSE3:APPLICATIONOFTHEWORKCLASSIFICATION3.1TheWorkClassificationpresentedhasdividedtypesofworkinto18mainclasses.Eachclasscomprisesuptoamaximumofsixdivisionswhichclassifyworkatsuccessivelevelsofdetail.Eachdivisioncomprisesalistofuptoninedescriptivefeaturesofwork.EachitemdescriptionintheBillofQuantitiesidentifiesthecomponentofworkcoveredwithrespecttoonefeaturefromeachdivisionoftherelevantclass.e.g.ClassH(precastconcrete)containsthreedivisionsofclassification.Thefirstclassifiesdifferenttypesofprecastunits,thesecondclassifiesdifferentunitsbytheirdimensions,andthethirdclassifiesthembytheirmass.Eachitemdescriptionforprecastconcreteunitsthereforeidentifiesthecomponentofworkintermsofthetypeofunit,itsdimensionsandmass.3.2Toavoidunnecessarylength,itemdescriptionsforPermanentWorksgenerallyidentifythecomponentoftheWorksandnotthetaskstobecarriedoutbytheContract,e.g.Anitemisdescribedas"MildSteelbarreinforcementtoSSRN126nominalsize20mm",notas"Supply,delivery,cut,bendandfixmildsteelbarreinforcementtoSSRN126nominalsize20mm".3.3Wheretheworkidentifiedbyanitemisspecificallylimited,thelimitationisstatedintheitemdescription,e.g."MildsteelbarreinforcementtoSSRN126nominalsize20mmexcludingsupplyanddeliverytotheSite".D:SMaulMyDocumentsProjectsKenyaCoastCoast6WSPTenderBOQCESMM-preamble-02-rev.doc
PreambletotheModifiedCESMM–SectionIVPagevofxItemdescriptionsforworkwhichisdividedbetweentwoclasseshassuchlimitationsstated,e.g.ItemdescriptionsformiscellaneousmetalworkinsertswhicharetobecastintoconcreterequireappropriateadditionaldescriptionifitemsaregiveninbothclassGforcastingintheinsertsandclassNforsupplyingtheinserts.3.4InpreparingtheBillsofQuantities,anattempthasbeenmadetohaveworkdividedintoitemsintheBillsofQuantitiessothatthecomponentofworkwhichisincludedineachitemdoesnotexhibitmorethanonefeaturefromeachdivisionofanyoneclassoftheWorkClassificatione.g.OneitemforprecastconcreteworkdoesnotincludemorethanoneofthetypesofconcreteunitlistedinthefirstdivisionofClassH,neitherdoesitincludedifferentunitswhosedimensionsarenotwithinoneoftheclassificationslistedintheseconddivisionofclassH,nordoesitincludedifferentunitswhosemassdoesnotliewithinoneoftherangeslistedinthethirddivisionclassH.3.5MeasurementrulesintheWorkClassificationsetouttheconditionsunderwhichworkshallbemeasuredandthemethodbywhichthequantitiesshallbecomputed,saveasotherwiseprovidedintheContract.3.6DefinitionrulesintheWorkClassificationdefinetheextentandlimitsoftheclassofworkrepresentedbyawordorexpressionusedintheWorkClassificationandinaBillofQuantitiespreparedinaccordancewiththisdocument.3.7CoveragerulesintheWorkClassificationprovidethattheworkstatedisdeemedtobeincludedintheContract.Acoverageruleisnothoweverexhaustiveorlimiting,doesnotstatealltheworkcoveredbyanitemanddoesnotprecludeanyoftheworkstatedbeingcoveredbyaMethod-RelatedCharge.CLAUSE4:CODINGANDNUMBERINGOFITEMS4.1ForconvenienceofreferenceeachitemintheWorkClassificationhasbeenassignedabillnumber,acodenumberconsistingofaletterandamaximumofsixdigits.TheinitialnumberdesignatestheBillNumber,thenextcapitallettercorrespondstotheclassintheWorkClassificationinwhichtheitemoccursandthedigitsgivethepositionoftheitemintherespectivedivisionsoftheclass.InthecaseofClassI,supplyofpipes,sewersandfittingsafinallowercaseletterdefinesthenominaldiameter.Code4I162.4midentifiesanitemasBillNumber4ClassIpipework–pipes,sewers&fitting-supplyFirstdivision1pipes&sewersSeconddivision6uPVCThirddivision2S&Sstandardjoints(ifmorethanthreedivisionsadecimalpointseparatesdivisionthreefromdivisionfour)Fourthdivision4N.P.9/10Fifthdivisionmdia.200mm.Sixthdivision(1-9)ifrequiredtodifferentiatebetweenitemsD:SMaulMyDocumentsProjectsKenyaCoastCoast6WSPTenderBOQCESMM-preamble-02-rev.doc
PreambletotheModifiedCESMM–SectionIVPageviofx4.2CodenumbersmaybeusedtonumbertheitemsintheBillofQuantities.4.3WhereafeatureofanitemisnotlistedintheWorkClassificationandthedigit9hasnotbeencategoriseditmayhavebeenusedintheappropriatepositionsinthecodenumber.CLAUSE5:PREPARATIONOFTHEBILLOFQUANTITIES5.1AppropriateprovisionsofthisClauseshallalsoapplytothemeasurementofcompletedwork.5.2TheBillsofQuantitiesshallbeconsideredasconsistingofthefollowingparts.(a)PreambletoBillsofQuantities(b)ModifiedCESMM(i)PreambletoModifiedCESMM(ii)WorkClassificationWheretherearesignificantbuildingworks,thesearemeasuredaccordingtotheStandardMethodofMeasurementofBuildingWorks(SMMBW)ofanacceptableArchitecturalAssociation(basedonthatpublishedbyRoyalInstitutionofCharteredSurveyors,London).(c)SMMBW(i)GeneralRules(ii)WorkClassifications(c)or(d)BillsofQuantitiesforindividualLots,eachdividedinto:(i)GrandSummary(ii)Workitems(dividedintoBills)(iii)DayworkSchedule5.3TheDayworkSchedulecomprisesalistofvariousclassesofLabour,MaterialandPlantforwhichtheTendereristoinserthisDayworkrates(inclusiveofoverheadsandprofit)fortheseparateitems.ThesearethenbecumulatedandcarriedforwardtotherespectivePreliminaryandGeneral(Bill1)items,asProvisionalSums.5.4Dayworkratesforstaffshallincludetransporttothesitesofworkaboutthesite,overtimeunlessworkisspecificallyinstructedtobeexecutedoutsidenormalworkinghours,superintendance,allowances,insurances,toolsofthetrade,protectiveclothing,andconsumablesnormallyoccasionedinpursuitoftheirtrade.TheratesaretobepricedonthebasisofthestaffbeingonthesiteorengagedfromthevicinityofthesiteatthetimeworksareorderedtobeexecutedonDayworksrates.Paymentshallbeonthebasisofthetimesactuallyworked,excludinganymealorrecesstimes.5.5Dayworkratesformaterialsshallincludeprocurement,transporttosite,loading,offloading,handling,storage,transporttotheplaceofusageandminormaterialsnormallyassociatedwithusageofthematerialsuchasnailsfortimberandbindingwireforreinforcement.5.6Dayworkratesforplantshallincludefuel,oils,lubricants,maintenance,insurance,andthecostofanyoperators,drivers,loadersandthelike.Paymentshallbeforanyreasonabletimespentinactualtraveltothesite(notexceedingthatfromthecapitalcity)andforthetimeofactualactiveusageinexecutingwork.Thecostsofanyloadertotransporttheplantshallnotbepaidforseparately.5.7EachpartoftheBillofQuantitieshasbeengivenaheadingandgroupsofitemswithineachparthasbeengivensub-headings.Headingsandsub-headingsshouldbereadaspartoftheD:SMaulMyDocumentsProjectsKenyaCoastCoast6WSPTenderBOQCESMM-preamble-02-rev.doc
PreambletotheModifiedCESMM–SectionIVPageviiofxitemdescriptiontowhichtheyapply.Alinehasbeendrawnacrosstheitemdescriptioncolumnbelowthelastitemtowhicheachheadingorsubheadingapplies.5.8Generally,allworkhasbeenitemisedandtheitemsdescribedinaccordancewiththeWorkClassification,buttherearedeviationsfromthiswherethenature,location,importanceoranyotherspecialcharacteristicoftheworkisthoughtlikelytogiverisetospecialmethodsofconstructionorconsiderationofcost.5.9DescriptionsintheBillsofQuantitiesitemsidentifytheworkcoveredbytherespectiveitems,buttheexactnatureandextentoftheworkistobeascertainedfromtheDrawings,SpecificationandConditionsofContract,asthecasemaybe,readinconjunctionwiththeWorkClassification.5.10AnydetailordescriptionrequiredtobegivenwiththeWorkClassificationmayhavebeenomittedfromanitemdescriptionprovidedthatareferenceisgiveninitsplacewhichidentifieswheretheomittedinformationmaybefoundonadrawingorintheSpecification.5.11WhereanitemdescriptioncompiledinaccordancewiththeWorkClassificationisconsideredinsufficienttoidentifyclearlytheparticularworkcoveredbytheitemadditionaldescriptionmayhavebeengiventoidentifytheworkbyreferencetoitslocationorotherphysicalfeaturesshownontheDrawingsordescribedintheSpecification.5.12WhereallthecomponentsofworkincludedinanitemareofonedimensionwithinarangegivenintheWorkSpecificationsthatdimensionmaybestatedintheitemdescriptioninplaceoftherangeofdimensions.5.13EachPrimeCostItemisfollowedbyanitemforapercentageadjustmentinrespectoftheContractorscostsinconnectiontherewithwhich,intheabsenceofanyexpressprovisionintheContracttothecontrary,shallinclude:(a)inanycaseinwhichanominatedSub-ContractoristocarryoutworkontheSite,forallowinghimtousetemporaryroads,scaffolding,hoists,mess-rooms,sanitaryaccommodationandwelfarefacilitieswhichareprovidedbytheContractorforhisownuseandforprovidingspaceforofficeaccommodationandstorageofplantandmaterials,fordisposingofrubbishandforprovidinglightandwaterfortheworkoftheNominatedSub-Contractor,fortheContractorsupervising,co-ordinatingtheNominatedSub-Contractor"swork,andfortheContractorassumingriskandresponsibilityinconnectionwithsuchwork;and(b)inanycaseinwhichtheworkisnottobecarriedoutbyanominatedSub-contractor,formakingprocurement,unloading,storingandhoistingmaterialssuppliedbyhimanddisposingofpackagingmaterials.5.14Whereanygoods,materialsorservicesaretobesuppliedbyaNominatedSub-Contractor,referencehasbeenmadeinthedescription,orintheappropriateheadingorsub-heading,ofthePrimeCostItemunderwhichthegoods,materialsorservicearetobesupplied.5.15AProvisionalSumforageneralcontingencyallowance,isgivenintheGrandSummarytotheBillsofQuantitiesforeachLot.ThissumisonlytobeexpendedontheEngineer"sinstructions.5.16Quantitiesshallbecomputednet,unlessdirectedotherwisebyameasurementruleinthisdocumentorbytheContract,andnoallowanceshallbemadeforbulking,shrinkageorwaste.D:SMaulMyDocumentsProjectsKenyaCoastCoast6WSPTenderBOQCESMM-preamble-02-rev.doc

PreambletotheModifiedCESMM–SectionIVPageixofxCLAUSE7.METHOD-RELATEDCHARGES7.1ForthepurposeofthisClausethefollowingwordsandexpressionsshallhavethemeaningsherebyassignedtothem.(a)"Method-RelatedCharge"meansthesumforaniteminsertedintheBillofQuantitiesbyaTendererinaccordancewithSub-clause7.2.(b)"Time-RelatedCharge"meansaMethod-RelatedChargeforworkthecostofwhichistobeconsideredasproportionaltothelengthoftimetakentoexecutethework.(c)"FixedCharge"meansaMethod-RelatedChargewhichisnotaTime-Relatedcharge.7.2ATenderermayinsertintheBillofQuantitiessuchitemsforMethod-RelatedChargesashemaydecidetocoveritemsofworkrelatingtohisintendedmethodofexecutingtheWorks,thecostsofwhicharenottobeconsideredasproportionaltothequantitiesoftheotheritemsandforwhichhehasnotallowedintheratesandpricesfortheotheritems.7.3WherepossibletheitemisationofMethod-RelatedChargesshouldfollowtheorderofclassificationandtheotherrequirementssetoutinclassAoftheWorkClassification,distinguishingbetweenTime-RelatedChargesandFixedCharges.Method-RelatedChargesmaybeinsertedtocoveritemsofworkotherthanthosesetoutinclassA.7.4EachitemforaMethod-RelatedChargeinsertedintheBillofQuantitiesshallbefullydescribedsoastodefinepreciselytheextentoftheworkcoveredandtoidentifytheresourcestobeusedandtheparticularitemsofPermanentWorksorTemporaryWorks,ifany,towhichtheitemrelates.7.5TheinsertionbytheContractorofanyitemforaMethod-RelatedChargeintheBillofQuantitieswhentenderingshallnotbindhimtoadoptthemethodstatedintheitemdescriptioninexecutingtheWorks.7.6Method-RelatedChargesshallnotbesubjecttoanymeasurement.7.7IntheeventofthesatisfactoryexecutionofanypartoftheWorkswhichhasbeenthesubjectofanitemforaMethod-RelatedChargeusing,whetherinwholeinpart,amethodotherthanthatdescribedintheitem,theContractorshallneverthelessbeentitledtopaymentoftheMethod-RelatedCharge,orthebalancethereof,asthecasemaybe,bysuchinstalmentsatsuchtimesanduponsucheventsasmayfromtimetotimebeagreedbetweentheEngineerandtheContractor.TheamountofaMethod-RelatedChargeshallbeneitherincreasednordecreasedbyreasononlyofanychangeinmethodmadebytheContractorofConditionsofContract,unlesssuchchangehasbeenorderedbytheEngineer,inwhichcasetheprovisionsofClause52shallapply.CLAUSE8.WORKCLASSIFICATIONTheWorkClassificationstoapplyareasfollowsClassA:GeneralItemsClassB:GroundInvestigation(notused)ClassC:Geotechnicalandotherspecialistprocesses(notused)ClassD:DemolitionandsiteclearanceClassE:EarthworksD:SMaulMyDocumentsProjectsKenyaCoastCoast6WSPTenderBOQCESMM-preamble-02-rev.doc
